Naturacha – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Naturacha website, mobile apps, and any other services (collectively, the “Platform”) operated by Naturacha. (“Naturacha, we, us, our”). By accessing or using the Platform (including browsing, creating an account, placing an order, or contacting support) you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Platform Overview
1.1 Marketplace Model – Naturacha is a curated marketplace that makes available products and brands that have passed our independent, strict quality‑check process. We do not manufacture, own, or directly control the inventory of the third‑party sellers (“Sellers”).

1.2 Service Scope – The Platform enables you to:

Browse product listings, read descriptions, and view images.
Purchase products from Sellers through our integrated checkout (Shopify).
Communicate with Sellers via our messaging system (where available).
Access support, order tracking, and account‑management tools.
2. Acceptance of Terms
2.1 By creating an account, placing an order, or otherwise using the Platform you represent that you are at least 18 years old (or have the legal capacity to enter into binding contracts).

2.2 If you are acting on behalf of a business, you represent that you have authority to bind that entity to these Terms.

2.3 These Terms constitute a binding agreement between you and Naturacha.

3. Account Registration & Security
3.1 You must provide accurate, current, and complete information when registering.

3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3.3 Notify us immediately at support@naturacha.com if you suspect unauthorized use of your account.

4. Purchases & Payments
4.1 All purchases are subject to product availability, pricing, and any promotional terms displayed on the Platform.

4.2 Payments are processed by third‑party payment processors (e.g., razorpay). We do not store your payment card details.

4.3 Prices are listed in Indian Rupees (INR) unless otherwise indicated and include applicable taxes unless stated otherwise.

4.4 You authorize Naturacha to charge the payment method you provide for the total order amount, including any applicable shipping, taxes, and fees.

5. Seller Relationship & Product Information (updated)
5.1 Seller Responsibility – Sellers are solely responsible for the accuracy of product descriptions, ingredient lists, nutritional information, labeling, and compliance with applicable food‑safety regulations.

5.2 Multiple Suppliers per Product Type – A single product category (e.g., “Acacia Honey”) may be supplied by multiple independent brands or farmers on the Naturacha platform. All such suppliers have successfully completed our intense, independent quality‑check process before being allowed to list their items. Consequently, while the product name and basic specifications may be identical across listings, the underlying source (brand/farmer) can differ.

5.3 Image Disclaimer – All photographs, graphics, and visual assets displayed on the Naturacha website or mobile app are illustrative only and are not guaranteed to be the exact images of the specific batch you will receive. Variations in color, texture, or appearance may occur due to natural differences between harvests, lighting conditions, or packaging. By placing an order, you acknowledge and accept that the actual product may look slightly different from the reference images shown.

5.4 Quality Assurance – Naturacha conducts independent quality checks on every Seller before onboarding and performs periodic audits to ensure continued compliance. This assurance applies to all brands/farmers that appear on the platform, regardless of whether they supply the same product type.

5.5 Disclaimers – We do not guarantee the completeness, reliability, or suitability of any product for any particular purpose. All health, dietary, or therapeutic claims are the responsibility of the Seller and must comply with local law.

6. Shipping, Returns & Refunds
6.1 Shipping terms, costs, and estimated delivery windows are displayed at checkout.

6.2 Because our products are perishable natural foods, returns are accepted only under the limited circumstances described in our Returns & Refund Policy (available at /return-policy).

6.3 Refunds, when approved, will be issued to the original payment method within the timeframe specified in that policy.

7. Intellectual Property
7.1 All content on the Platform (text, logos, designs, software, trademarks, etc.) is owned by Naturacha or licensed to us, except for Seller‑provided product images and descriptions, which remain the property of the respective Seller.

7.2 You may not reproduce, modify, distribute, or create derivative works of any Platform content without our prior written consent.

7.3 Reference Images – The illustrative images used on the Platform are solely for marketing purposes. They may not accurately depict the exact product batch you receive, and you agree not to rely on them as a definitive representation of the physical goods.

8. User‑Generated Content
8.1 You may submit reviews, comments, or other content (“User Content”) including on social media. By doing so you grant Naturacha a worldwide, royalty‑free, sublicensable, irrevocable license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with the Platform.

8.2 You represent that your User Content does not infringe any third‑party rights, is not defamatory, obscene, illegal, or otherwise objectionable.

8.3 We reserve the right to remove any User Content at our sole discretion.

9. Prohibited Conduct
You agree not to:

Violate any applicable law or regulation.
Submit false, misleading, or fraudulent information.
Interfere with or disrupt the Platform’s operation or security.
Scrape, harvest, or otherwise extract data from the Platform for commercial use without permission.
Engage in any activity that could harm Naturacha, Sellers, or other users.
10. Disclaimer of Warranties
10.1 THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR ACCURACY.

10.2 We do not warrant that the Platform will be uninterrupted, error‑free, or secure.

11. Limitation of Liability
11.1 To the maximum extent permitted by law, Naturacha, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of the Platform, even if we have been advised of the possibility of such damages.

11.2 Our total aggregate liability for any claim arising out of or relating to these Terms shall not exceed the amount you actually paid to Naturacha for the specific product(s) giving rise to the claim.

12. Indemnification
You agree to defend, indemnify, and hold harmless Naturacha, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of:

Your breach of these Terms;
Your violation of any law or third‑party right; or
Your User Content.
13. Privacy
Your personal data is processed in accordance with our Privacy Policy (available at /privacy). By using the Platform you consent to such processing.

14. Governing Law & Dispute Resolution
14.1 These Terms are governed by the laws of India, without regard to conflict‑of‑law principles.

14.2 Any dispute arising out of or relating to these Terms shall be resolved exclusively by the courts located in Srinagar, Jammu & Kashmir, India.

15. Modifications to the Terms
We may revise these Terms from time to time. If a material change is made, we will notify you via email or a prominent notice on the Platform. Continued use of the Platform after such notice constitutes acceptance of the revised Terms.

16. Termination
We may suspend or terminate your account and access to the Platform at any time, with or without cause, and without prior notice. Upon termination, all licenses granted herein cease, and you must promptly discontinue any further use of the Platform.

17. Miscellaneous
Severability: If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Naturacha concerning your use of the Platform.
No Waiver: Failure to enforce any right under these Terms does not constitute a waiver of that right.
